Background

Walter Joseph “Jay” Clayton III (born July 11, 1966, Newport News, Virginia) is an American attorney with more than 30 years of experience in law, regulation, and prosecution. He holds a B.S. in Engineering from the University of Pennsylvania (1988, summa cum laude), a B.A. and M.A. in Economics from the University of Cambridge (1990, Thouron Scholar), and a J.D. from the University of Pennsylvania Law School (1993, cum laude, Order of the Coif). He clerked for Judge Marvin Katz of the U.S. District Court for the Eastern District of Pennsylvania (1993–1995).

Clayton spent more than two decades as a partner at Sullivan & Cromwell LLP, where he co-headed the firm’s corporate practice and served on its Management Committee, specializing in corporate transactions and capital markets. From 2009 to 2017 he was also a Lecturer in Law and Adjunct Professor at the University of Pennsylvania Law School.

Trump nominated Clayton as Chair of the Securities and Exchange Commission in January 2017; he was confirmed 61–37 and served from May 4, 2017 to December 23, 2020. After the SEC he chaired Apollo Global Management and returned to Sullivan & Cromwell as Of Counsel. On April 22, 2025, Trump appointed him U.S. Attorney for the Southern District of New York (SDNY), one of the Justice Department’s most prestigious roles, where he has overseen prosecutions of former Venezuelan President Nicolás Maduro and others on drug trafficking charges.

Trump announced Clayton’s nomination as Director of National Intelligence in June 2026, calling him a “very Highly Respected” nominee to lead the nation’s 18 intelligence agencies and serve in his Cabinet. Clayton would succeed acting DNI Bill Pulte (a mortgage official with no intelligence background), who had replaced Tulsi Gabbard after Gabbard resigned in May 2026 citing her husband’s cancer diagnosis.

Nomination History

July 15, 2026 Senate Confirmation Hearing

Refusal to confirm the 2020 election result

The most contentious portion of the hearing concerned Clayton’s repeated refusal to state directly that Joe Biden won the 2020 presidential election — a verified factual matter confirmed by every federal court, election official, and intelligence agency that reviewed it.

On multiple occasions, Democratic senators asked the question directly. Clayton’s standard response: “I’m not an election denier. Joe Biden was certified as the president of the United States.” He also said, “He had the most electoral votes. He was declared the winner” and “He went through our electoral process” — but consistently refused to use the word “won.”

The exchange with Sen. Jon Ossoff (D-GA) became the most pointed of the hearing:

Ossoff: “Who won the 2020 election?” Clayton: “I’m not going to do this with you.” Ossoff: “You refuse to answer a basic question about who won a presidential election, but you ask to lead America’s intelligence community? Isn’t it humiliating to be unable to answer this question, to have to indulge the president’s delusions? We know, you know, everybody in this room knows the truthful answer to that question. Why can you not give it?”

When Clayton protested “I think I’ve answered the question — we can keep doing this,” Ossoff replied: “Well we’re going to keep doing it because you’re not being honest or forthright with the committee.” Ossoff called Clayton’s overall responses “disqualifying.”

Sen. Mark Kelly (D-AZ) pressed further, noting that Clayton had said Biden “had the most electoral votes” and was “declared the winner,” then asked: “And who has the most electoral votes? Is it the person who wins or the person who loses?” Clayton did not answer directly. Sens. Mark Warner (D-VA) and Angus King (I-ME) also separately attempted to elicit a direct answer and were denied one.

CyberScoop (July 15, 2026) noted that the “certified, not won” formulation Clayton employed is the standard evasion adopted by Trump administration nominees to avoid upsetting the president, who has maintained despite all evidence that he lost the 2020 election — and that the pattern is particularly troubling for a nominee to lead the intelligence community, whose core function is delivering accurate information regardless of political palatability.

Sen. Mark Kelly framed the stakes directly: “It’s not about softening the edges when the truth is unpleasant. It’s about delivering information.”

AP News (July 16, 2026) reported Clayton’s testimony in the context of Trump’s broader effort to use the levers of power to rewrite the settled history of 2020, noting that a federal document Trump himself signed last year declared “there has been no evidence of a foreign power altering the outcome or vote tabulation in any United States election.”

Tulsi Gabbard and the Georgia election office raid

Sen. Ossoff also questioned Clayton about his awareness that former DNI Tulsi Gabbard was physically present at an FBI raid of a Fulton County, Georgia election office in January 2026 — a raid connected to Trump’s push to re-investigate the 2020 election. Fulton County is at the center of Trump’s fraud claims.

Clayton claimed he had only learned of Gabbard’s involvement from Ossoff during a private meeting earlier in the week — despite the incident having been widely reported. Clayton also claimed not to know whether Gabbard testified that her presence at the raid was “requested by the president.”

When Ossoff asked directly: “Is it appropriate for the director of national intelligence to oversee the execution of domestic search warrants at sensitive election facilities? Yes or no?” — Clayton did not answer.

“You’re being evasive,” Ossoff said. “Your answers lack credibility. Your testimony lacks credibility.” (CNN, July 15, 2026)

Ossoff noted that the Senate Intelligence Committee is actively probing Gabbard’s involvement in the raids.

New York Times journalist subpoenas

The hearing was also dominated by Clayton’s role in subpoenaing four New York Times journalists the preceding Friday (July 11, 2026), seeking their grand jury testimony regarding reporting on security concerns with the new Qatari-gifted presidential aircraft. The Times had reported that the plane lacked some of the prior Air Force One’s security features, including antimissile capabilities. Some subpoenas were delivered to the journalists’ homes.

Senators pressing Clayton on this issue included Sens. Ron Wyden (D-OR), Michael Bennet (D-CO), and Kirsten Gillibrand (D-NY).

Wyden accused Clayton of attacking press freedom and the First Amendment, and questioned whether the subpoenas followed DOJ policy requiring all reasonable alternative avenues be exhausted before subpoenaing journalists. Clayton declined to address specifics, citing an ongoing investigation, but said he was “confident that the procedures that we have in place to protect the First Amendment” were followed.

Gillibrand called the process of serving subpoenas at the journalists’ homes “rushed” and “aggressive,” saying: “This just doesn’t ring true that your process was a thoughtful, deliberative, and normal oversight process, and that is why this committee is deeply concerned.” Clayton responded: “This was a judgment. And it should always be a judgment that’s made collectively.”

The Committee to Protect Journalists called the subpoenas “an extraordinary escalation in President Trump’s efforts to threaten and intimidate independent news organizations and have a chilling effect on the work of journalists across the country.” The Justice Department maintained that leakers, not reporters, were the targets of any investigation.

Republicans on the committee did not raise serious concerns about the subpoenas.

Election security and intelligence community restructuring

On election security more broadly, Clayton said ODNI’s responsibilities were “principally” outside the United States. He committed to assessing whether ODNI’s cyber and foreign influence components — downsized under Gabbard — should be resourced again. He described cybersecurity as “top-of-mind” for him, particularly regarding election influence matters.

Republican support

Committee Chair Tom Cotton (R-Ark.) asked Clayton near the outset to confirm that he was not involved with intelligence reports about foreign election interference (since he is not yet DNI), and otherwise offered him supportive framing. Republicans did not press Clayton on any of the Democratic concerns.

Bipartisan Standing Before the Hearing

Before the July 15 hearing, Clayton had drawn unusually broad bipartisan praise for a Trump nominee. Sen. Mark Warner (D-VA), the panel’s ranking Democrat, had said in June that he had “known and respected Jay Clayton for many years and believe he is a capable public servant” — while stopping short of committing a vote. Republican senators including Lankford, Rounds, and Scott praised Clayton’s SEC tenure and SDNY prosecutorial record.

Politico (July 16, 2026) reported that Democrats “thought highly of Clayton heading into the day” — making his refusal to confirm the 2020 election result and his evasiveness on Gabbard and the subpoenas particularly alarming to senators who had been potential “yes” votes.
