“Kraken” Litigation Theory

Powell’s signature contribution was the dramatic conspiracy-theory framing alleging:

  • Dominion Voting Systems was a Venezuelan-government-controlled vote-flipping operation
  • Cuba and China were allegedly involved
  • Hugo Chavez (deceased 2013) was allegedly responsible for Dominion’s design
  • Multiple state elections were allegedly rigged through this mechanism

Operational Role

  • Pursued litigation in multiple states
  • Provided rhetorical framework that movement consumed
  • Sustained electoral-fraud narrative through 2021
  • Direct influence on Trump base belief structure

December 18, 2020 Oval Office Meeting

  • Joined Flynn, Patrick Byrne, Trump
  • Proposed: martial law / military seizure of voting machines / appointing Powell as Special Counsel
  • White House Counsel and other advisors pushed back

For Trump Supporters: Questions Worth Considering

Sidney Powell was a former federal prosecutor who wrote a book (Licensed to Lie, 2014) criticizing government prosecutors for making false statements and suppressing evidence in high-profile cases. In November 2020, she held a press conference at RNC headquarters alleging that Dominion Voting Systems was a Venezuelan government-controlled operation, that Hugo Chavez (who had died in 2013) had designed it to flip votes, and that Cuba and China were also involved. The Trump campaign formally distanced itself from her three days later. In December 2020, she was in an Oval Office meeting where she and Mike Flynn proposed that Trump declare martial law, seize voting machines by military force, and appoint Powell as Special Counsel for election fraud. White House counsel pushed back. In October 2023, she pleaded guilty to six misdemeanor counts of conspiracy to commit election fraud in Georgia. Dominion Voting Systems has a $1.3 billion defamation lawsuit pending against her; Smartmatic has another.

Here’s a question worth sitting with: Powell wrote an entire book about the dangers of government officials making false statements and suppressing evidence. She had made her reputation arguing that prosecutors should be held to rigorous standards of accuracy and honesty. She then made public allegations — that Hugo Chavez’s ghost somehow controlled American voting machines, that Venezuela and Cuba had coordinated to steal the American election — that were not just unsupported but factually impossible. Courts imposed sanctions on her. The Trump campaign itself said she was too extreme. She has since pleaded guilty to election fraud conspiracy. What does it tell you about the “Stop the Steal” operation that one of its principal architects has a guilty plea, multi-billion-dollar defamation judgments pending, and the specific claim that a dead Venezuelan president stole the election?

A second question: Powell’s “Defending Republic Inc.” fundraising operation raised substantial money from Trump supporters on the strength of her election-fraud claims — money used in part for her legal defense. The people who donated believed her claims were true. She has since pleaded guilty, acknowledging what she did was criminal. Those donors’ money went to defending someone who was, as she has admitted, engaged in criminal conduct to spread false election claims. What accountability standard would you apply to someone who raised money from their supporters based on claims they have subsequently admitted were part of a criminal scheme?

If the answer is yes, then that standard applies here too. Consistent standards for powerful people aren’t partisan. They’re the foundation of any system where laws matter more than who you know.

A second question: The people documented in these profiles hold, or have held, significant power over systems that affect your life — government programs, elections, law enforcement, the economy. When powerful people act in ways that benefit themselves or their allies rather than the public they serve, the costs fall on everyone. That’s true regardless of party.

You don’t have to agree with every political perspective represented in this knowledge base. You just have to ask whether the documented facts meet your own standard for how public officials should conduct themselves. That’s a question every citizen has the right — and the responsibility — to ask.
